By accessing or using the spctive.com website and related services (collectively, the "Service"), operated by Spctive ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We may modify these Terms at any time, and your continued use of the Service following any changes constitutes your acceptance of the revised Terms.

2. Description of Service

Spctive is an AI-powered news perspective analysis platform. We aggregate publicly available news stories and use artificial intelligence to analyze how different sources, regions, and editorial perspectives cover the same events. The Service provides users with tools to explore media framing, identify areas of agreement and disagreement across outlets, and develop a more comprehensive understanding of current events.

3. User Accounts

To access certain features of the Service, you must create an account. When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activity that occurs under your account
  • Notify us immediately of any unauthorized access or use of your account

You must be at least 16 years of age to create an account. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.

4. Content and Intellectual Property

Source Articles

The Service references and links to news articles published by third-party sources. We do not own, control, or claim any intellectual property rights over these source articles. All original reporting, text, images, and other content from third-party sources remain the property of their respective publishers. Our use of this content is limited to referencing, linking, and providing analytical commentary.

Our Analysis and Platform Content

The perspective analyses, comparison tools, agreement scores, editorial framing assessments, and all other original content generated by or for the Service are the intellectual property of Spctive. This includes, but is not limited to, our AI-generated summaries, perspective breakdowns, regional coverage comparisons, and the design, code, and visual elements of the platform.

Images displayed on the Service are sourced from Pexels and are used in accordance with the Pexels license. These images remain the property of their respective photographers and are subject to the terms of the Pexels license agreement.

5. Subscription and Billing

Spctive offers both free and paid subscription tiers. By subscribing to a paid plan, you agree to the following:

  • Payment processing: All payments are processed securely through Stripe. We do not store your full payment card details on our servers.
  • Recurring billing: Paid subscriptions are billed on a recurring basis (monthly or annually, depending on your selected plan) unless you cancel before the next billing cycle.
  • Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period, and you will retain access to paid features until that period expires.
  • Refunds: Subscription fees are generally non-refundable. However, if you experience a billing error or are charged after cancellation, please contact us and we will work to resolve the issue.
  • Price changes: We may adjust subscription pricing from time to time. We will notify you of any price changes at least 30 days in advance, and the new pricing will apply at the start of your next billing cycle.

6. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party rights
  • Scrape, crawl, or use automated means to access the Service or extract data without our prior written consent
  • Interfere with or disrupt the Service, its servers, or connected networks
  • Attempt to gain unauthorized access to any part of the Service or other users' accounts

  • Use the Service to spread misinformation or misrepresent our analyses as your own original work

We reserve the right to investigate and take appropriate action, including suspending or terminating your account, if we determine that you have violated these provisions.

  • Not a primary news source: Spctive is an analytical tool, not a news publisher. We do not produce original journalism. Our analyses are designed to complement, not replace, your consumption of news from established sources.
  • AI limitations: Our analyses are generated using artificial intelligence, which may occasionally produce inaccuracies, mischaracterizations, or incomplete assessments. AI-generated content should not be treated as definitive or infallible. We encourage users to consult original sources and exercise independent judgment.
  • No endorsement: The inclusion of any news source, perspective, or viewpoint in our analyses does not constitute an endorsement of that source or viewpoint by Spctive.

In no event shall our total aggregate liability to you for all claims arising out of or related to the Service exceed the amount you have paid to us in subscription fees during the twelve (12) months immediately preceding the event giving rise to the claim, or fifty dollars (USD $50), whichever is greater.

You agree to indemnify, defend, and hold harmless Spctive and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

You may terminate your account at any time by deleting it through your account settings or by contacting us. We may suspend or terminate your access to the Service at our discretion, without prior notice, for conduct that we determine violates these Terms, is harmful to other users or the Service, or is otherwise objectionable.

Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability, and indemnification.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction.
